OKEECHOBEE — After reportedly pointing a gun at a two women and a child, and saying “I’m going to kill you,” 49-year-old Rafael Brito was charged with assault with a deadly weapon but without intent to kill. On Tuesday, Dec. 15, at approximately 8:30 p.m., Okeechobee County Sheriff’s Deputy Ashley Waskiewicz responded to the call. When she arrived, the complainant told her that Brito pointed a gun at her and threatened to kill her.
Waskiewicz went next door to Brito’s residence, and he was reportedly too inebriated to give a clear statement of the event. A witness said she and the complainant had been talking at the fence line dividing their properties earlier in the evening when Brito came out and started screaming at them. She said he went back inside and grabbed a single shot shotgun and pointed it in her direction.
The complainant and her child were standing in front of her on the other side of the fence. The witness told Brito not to point the gun at them several times, and she later told OCSO deputies she believed she was not his intended target but that he was aiming at the complainant. She then grabbed the gun and took it away from him. The complainant said when Brito was pointing the gun at them, he told them he was going to kill them both.
Four firearms were collected from the residence for safekeeping.
The report notes Brito does not have legal United States citizenship and is from Guatemala. His bond was set at $10,000.
