Man found slumped over the wheel in a running vehicle

OKEECHOBEE — After he was found slumped over the steering wheel of his car, a man was charged with DUI and possession of cannabis resin.

According to her report, Okeechobee City Police Officer Jessica Francis was on road patrol near U.S. 441 North and Northeast Second Street around 4:30 a.m. on Valentines Day when she noticed a white car sitting a few feet back from a stop sign. When she turned onto the street, she almost didn’t see the driver, because he was slumped over.

When she approached the vehicle, she saw a man, later identified as Brett Herbst, 23, slumped over with a breakfast sandwich in his hand. When she yelled to get his attention, he barely moved but made an attempt to lift the sandwich. Moving in slow motion, he dropped the sandwich before it got to his mouth.

Francis reached through the window and put the vehicle in park and again yelled to get Herbst’s attention. He did not open his eyes but began speaking to her. Francis could not understand anything he was saying and yelled again. Finally, Herbst responded by opening his eyes and attempting to explain where he was going.

When asked if he was under the influence, Herbst denied it and said he was just tired.

Based on her experience as a law enforcement officer, Francis determined Herbst was under the influence of a controlled substance and he was arrested. His bond was set at $3,000.
