Hallucinating patient allegedly kicks nurse

OKEECHOBEE — On Tuesday, Oct. 31, Thomas Marvel, 25, of Delray Beach, was arrested and charged with battery on a firefighter/emergency medical care provider for allegedly kicking a nurse at Raulerson Hospital for trying to assist him in urinating.

According to the arrest affidavit, on Friday, Oct. 27, Deputy Abdelquader responded to Raulerson Hospital, 1796 US 441 North, in reference to an assault/battery complaint.

A female employee of the hospital told the deputy that she had a male patient who had come from Ember Recovery Center at 9 a.m. that morning. The victim explained that Marvel was in the process of detoxing and when he arrived at Raulerson he was hallucinating and did not know where he was. Marvel apparently believed he was at his residence and was repeatedly calling out for his mom. He could only remember his name and his birthday. He did not know he was at a hospital.

According to the victim, Marvel woke up at one point with an urgency to urinate. He was confused and unsteady on his feet so the victim told him it was not safe for him to get out of bed. Due to Marvel’s hands shaking, the victim told him she would help him. Initially he declined the offer of help and laid back down but when the victim offered to help Marvel again he said, “Oh, OK.”

The victim then grabbed Marvel’s penis and advised him to begin urinating into the urinal. According to the victim, it was then that Marvel pulled his leg back and kicked her on the right side of her neck and jawbone area with his foot.

The victim stated that another male coworker was in the room when the incident took place and the coworker was questioned about the incident. He said that he was standing at the entrance to the room when he witnessed the altercation. He said that Marvel was very agitated and was yelling at the victim while she was trying to help him with the urinal. Marvel reportedly attempted to urinate on the victim and swung his leg towards her and kicked her in the face.

The deputy observed the victim’s person for any bruising, redness or marks to indicate she was kicked in the facial area but was unable to locate any on her person. The victim was advised that should any appear on the affected area to call Okeechobee County Sheriff’s Office so that photos could be taken and submitted into evidence.

The deputy observed Marvel restrained to the bed for safety reasons and Marvel appeared to be in and out of sleep and did not know where he was. Marvel called out for his “mom” several times but was mostly unable to speak due to hallucinations and sedatives he had been given. He had thick slurred speech and would try to repeat anything the victim or the deputy said.

Due to Marvel being unable to speak, a warrant was submitted for his arrest. He was held in the hospital for 72 hours before being released back to the recovery center when he was discharged.

Marvel was placed under arrest on Thursday, Oct. 31, and charged with battery on a firefighter/emergency medical care provider.

Bond was set at $2,500.
